The tax credit was originally planned to be available in Q4 2021. However, the Senate-passed infrastructure deal eliminates Q4 ERTC, but the bill has not passed the House. If it doesn’t, then ERTC is still available for Q4. It is possible that Congress could eliminate ERTC eligibility during the very calendar quarter when it is in operation. The National Restaurant Association is working to stop this from happening but could use your help. The NYRSA is interested in identifying any operators currently using ERTC that would like to contact the NY Congressional delegation about this issue.
